— Terms

Clear rules. No surprises.

These Terms govern your use of CVVia, a product operated by MEDTIP GmbH (Passau, Germany). They are intentionally short. If anything reads unclear or unfair, write to us at hello@cvvia.ai — we will explain or reconsider.

01

Acceptance

By creating an account, uploading content, or otherwise using CVVia, you enter into a contract with MEDTIP GmbH (Innstraße 69b, 94032 Passau, Germany; HRB 13100; USt-IdNr. DE361378149) and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

If you are using CVVia on behalf of an organization, you confirm that you are authorized to bind that organization to these Terms.

02

Who can use CVVia

You must be at least 16 years old to create an account. At signup you confirm your age, and we store the timestamp of that confirmation together with your acceptance of these Terms. If you are under the age of majority in your country, you may need parental permission to enter into a binding contract — those local-law requirements apply on top of our 16+ minimum.

CVVia is available worldwide, but we may restrict access from jurisdictions where our services would be unlawful or where we have no practical way to support you.

03

Your account

You are responsible for keeping your login credentials secure and for activity that happens under your account. Notify us immediately at hello@cvvia.ai if you suspect unauthorized access.

One person, one account. Shared accounts are not permitted. Enterprise plans (when offered) provide bulk user management with separate logins.

Free accounts that have not been signed into for twenty-four (24) consecutive months may be suspended and the associated personal data deleted, consistent with our GDPR data-minimisation obligations. We send a reminder e-mail at least thirty (30) days before suspension; signing in within that window keeps the account active and resets the inactivity clock. Reactivation after suspension may not be possible if the data has already been deleted — export your data first if you want a copy. Paid accounts are exempt from this inactivity rule while a subscription is active.

04

Acceptable use

You agree not to use CVVia to:

  • Misrepresent facts about your identity, experience, or qualifications in a way that would deceive an employer or violate the law.
  • Submit unlawful, defamatory, harassing, or infringing content.
  • Attempt to reverse-engineer, scrape, or circumvent rate limits, authentication, or security features.
  • Resell, sublicense, or white-label CVVia output, prompts, or rendering themes as your own product without a written agreement with MEDTIP GmbH.
  • Upload malware, run automated bulk attacks, or probe for vulnerabilities outside our responsible-disclosure program (security@cvvia.ai).
  • Use CVVia to generate content that violates the rights of third parties, including copyright, trademark, or privacy.
  • Use CVVia to process other people's personal data without a lawful basis — for example, uploading someone else's CV without their permission.
05

Your content

Everything you upload or generate on CVVia — your profile data, CVs, cover letters, notes, interview answers — remains yours. We do not claim ownership.

You warrant that (a) you have the right to use the content you provide, (b) sharing it with CVVia does not breach any agreement you have with a third party (such as an employer non-disclosure agreement), and (c) the content is not someone else's personal data submitted without their consent.

You grant MEDTIP GmbH a limited, non-exclusive license to process that content solely to provide the service: store it, run AI models over it, generate new documents, and show it back to you. This license ends when you delete the content or your account.

06

AI-generated output

CVVia uses large language models to draft CVs, cover letters, emails, and interview practice answers. These models can make mistakes: hallucinated facts, misattributed experience, dated information. You are responsible for reviewing and editing every output before sending it to an employer or other recipient.

Optional voice synthesis (interview-prep audio playback) is a best-effort feature; it may be temporarily unavailable and falls back to your browser's native speech synthesis.

We do not warrant that AI output will result in interviews, offers, or any specific outcome. The product is an assistant — the judgment is yours.

07

Feedback and suggestions

If you send us feedback (feature requests, bug reports, ideas, mock-ups, or any other suggestion), you grant MEDTIP GmbH a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate that feedback into the product or any future product, without compensation or attribution to you. You are not obliged to send feedback — but if you do, this is how we can act on it freely.

08

Our intellectual property

The CVVia name, logo, website design, source code, prompt templates, CV rendering themes, and underlying methods are the intellectual property of MEDTIP GmbH or properly licensed from third parties. You may use the service and keep the documents you generate for personal or internal business use, but you may not copy or redistribute the product itself, its prompts, or its themes.

09

Plans, billing, refunds

The Free plan is genuinely free, funded by paying customers. Pro and any future Enterprise plans are billed in advance by MEDTIP GmbH and renew automatically unless you cancel before the renewal date. You can cancel anytime from Settings or by writing to billing@cvvia.ai; cancellation takes effect at the end of the current billing period and the unused portion is not refunded by default — see the right-of-withdrawal and goodwill-refund sections below for the exceptions.

EU consumers ordinarily have a 14-day right of withdrawal under Directive 2011/83/EU (transposed into German law via §312g BGB). At checkout we ask for your express prior consent to begin performance of the service immediately and ask you to acknowledge that you lose this 14-day right of withdrawal once we begin performance. If you give that consent and then use any AI-driven feature of the service — generating a CV, cover letter, ATS check, interview practice session, or company research — the right of withdrawal lapses for that subscription period under Article 16(a) of the Directive. If you do not use any AI-driven feature within 14 days of paying, you may withdraw and receive a full refund.

If you withdraw before using any AI-driven feature but after access has been granted, you owe a pro-rata fee for the days during which the service was available to you, calculated as the period fee × (days elapsed / total days in the period). We deduct this amount from the refund.

Pro plans also carry a 30-day goodwill refund window. This is a discretionary policy separate from your statutory rights and we may decline it where the request is inconsistent with reasonable use: refunds are generally not granted where you have completed more than ten AI generations (CVs, cover letters, ATS checks, or interview simulations combined), where your account has already received a goodwill refund in the past, where we detect automated or scripted usage, or where you have initiated a payment-card chargeback for the same charge. In those cases we may at our discretion offer a partial refund or service credit instead. To request a goodwill refund write to billing@cvvia.ai — no ticket system required, refunds return to the original payment method.

Taxes (VAT, sales tax, or local equivalents) are shown where applicable and charged based on your billing address. If a payment fails we will retry the charge and notify you; if it remains unpaid for seven days, paid features are suspended and you revert to the Free plan until billing is updated. MEDTIP GmbH retains billing records for the statutory retention period required under §257 HGB (currently 10 years) — this retention obligation is independent of any account deletion you initiate, and is the only category of personal data we are legally required to keep after deletion.

10

Warranties and disclaimers

CVVia is provided "as is" and "as available." We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance and occasional outages do happen — including outages of upstream providers (Firebase, OpenAI, Anthropic, Google AI, Microsoft) that we depend on but do not control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — including, for EU consumers, rights under the applicable consumer-protection laws (including BGB §307 for German consumers); for Turkish consumers, rights under the Türk Borçlar Kanunu and Tüketicinin Korunması Hakkında Kanun.

11

Limitation of liability

To the maximum extent permitted by law, MEDTIP GmbH is not liable for indirect, incidental, special, or consequential damages — including lost profits, lost opportunities, reputational harm, or employment outcomes — arising from your use of CVVia.

MEDTIP GmbH's total aggregate liability under or in connection with these Terms is limited to the fees paid by you to MEDTIP GmbH for CVVia in the 12 months immediately preceding the event giving rise to the claim. For Free-plan users where no fees have been paid, this cap is zero.

This limitation does not apply to liability that cannot be excluded under mandatory law, including liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or other matters which mandatory consumer-protection law preserves.

12

Your warranty and indemnification

You warrant that the content you submit to CVVia is lawful, is yours to share, and does not infringe the rights (including IP, privacy, or contractual rights) of any third party. You will indemnify and hold MEDTIP GmbH harmless from third-party claims, losses, damages, and reasonable legal costs arising from (a) your breach of these Terms, (b) content you submitted that turns out to infringe someone's rights, or (c) your unlawful use of the service.

This indemnity does not apply to claims arising from MEDTIP GmbH's fraud, gross negligence, or willful misconduct — and does not override mandatory consumer-protection law that would limit indemnification by a consumer.

13

Force majeure

MEDTIP GmbH is not in breach of these Terms, and is not liable for delay, missed SLAs, or non-performance, where the cause is beyond our reasonable control. This includes — but is not limited to — outages of upstream AI providers (OpenAI, Anthropic, Google AI, Microsoft), Firebase or Google Cloud incidents, internet or DNS provider failures, government action, sanctions, war or armed conflict, terrorist acts, natural disasters, pandemics, labor disputes, and supply-chain disruptions.

Force majeure refund only applies where the same event prevents performance for fourteen (14) or more consecutive days. In that case the affected party may terminate the affected subscription and we will refund a pro-rata amount calculated on the consecutive days the service was unavailable — not the full unused remainder of the term. Short, recurring, or partial outages of upstream providers do not on their own qualify as a force majeure event for refund purposes.

14

Suspension and termination

You can close your account at any time from Settings → Delete account, or by writing to hello@cvvia.ai. Closing your account triggers the data-deletion process described in our Privacy Policy.

MEDTIP GmbH can suspend or terminate accounts that materially violate these Terms, pose a security risk, or cause us to violate law. We will notify you and, where practical, give you a chance to export your data via Settings → Download my data before suspension.

Sections that by their nature should survive termination — including fees and refunds, your warranties, indemnification, intellectual property, limitation of liability, governing law and disputes, and notices — survive after this contract ends.

15

Changes to these Terms

MEDTIP GmbH may update these Terms when we add features, switch processors, or when law requires. Material changes will be announced at least 14 days in advance via email and an in-app banner. Continued use after the effective date means you accept the update; if you do not, cancel before it takes effect — your data export remains available.

16

Severability, entire agreement, assignment, notices

Severability: if any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.

Entire agreement: these Terms, together with the Privacy Policy, Cookies Notice, and the current Subprocessors list, constitute the entire agreement between you and MEDTIP GmbH regarding CVVia and supersede any prior agreement on the same subject. In case of conflict, the Privacy Policy governs data-processing topics; these Terms govern everything else.

Assignment: you may not assign or transfer these Terms or any rights or obligations under them. MEDTIP GmbH may assign these Terms in connection with a merger, acquisition, restructuring, or sale of substantially all its assets, in which case you will be notified.

Notices: formal notices to you go to the email address on your account. Formal notices to MEDTIP GmbH must be sent to legal@cvvia.ai and, where required by law, by registered mail to MEDTIP GmbH, Innstraße 69b, 94032 Passau, Germany.

17

Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-laws principles, and excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection laws of your country of residence remain applicable and are not waived.

We prefer to solve disputes informally — please write to legal@cvvia.ai first. The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/. MEDTIP GmbH is not obliged to participate, and generally does not participate, in arbitration proceedings before a consumer arbitration body (Verbraucherschlichtungsstelle).

Where mandatory law permits, the courts of Passau, Germany have non-exclusive jurisdiction over any dispute. EU consumers retain the right to bring proceedings in the courts of their country of residence as required by Brussels I bis (Regulation 1215/2012).
